This research includes a doctrinal analysis of the trade secret as a legal institution. The trade secret is a legal institution of great relevance, insofar as it boosts the development of industry and business by protecting information and knowledge that are not accessible to the public and constitute an advantageous result in the market. The marked value of economic-commercial nature that the business secret has forged the implementation of measures for its legal protection. In spite of the transformations carried out in Cuba in the field of intellectual property, there are still insufficiencies in the legal regulation of trade secrets that deserve special attention. The implementation of a regulation that substantively regulates the institution with reference to developmental norms constitutes a necessity in terms of the protection of entrepreneurs and their interests. The issue in question is of great importance in the process of updating the Cuban economic model, as well as the protection of rights within the national industry.
